Last Updated: January 1, 2025 1. Consent to Text Messaging By providing your mobile number and opting in, you consent to receive SMS/text messages via the Scriptyx platform. These messages will be limited to appointment scheduling and administrative coordination (e.g., reminders, confirmations, and rescheduling notices) on behalf of your healthcare provider. Scriptyx is not a healthcare provider and does not control the content or timing of these messages. Standard message and data rates may apply. You may opt out at any time by replying STOP. 2. Nature of the Service Scriptyx provides a communication platform used by healthcare providers to send administrative messages. Text messages sent through Scriptyx’s system do not include medical advice, clinical content, or Protected Health Information (PHI) and are not intended for use in emergencies or time-sensitive medical matters. For urgent needs, contact your provider directly or call 911. 3. Privacy and Security Scriptyx does not store or transmit PHI via its texting service. Messages are limited to non-clinical scheduling functions. While we implement industry-standard safeguards, SMS is not a secure method of communication. Scriptyx disclaims responsibility for any risks associated with SMS delivery, including delayed or misdirected messages. 4. Relationship with Providers Scriptyx acts as a technology vendor to healthcare providers. Each provider is solely responsible for complying with applicable laws, including HIPAA, when using Scriptyx’s services. Scriptyx does not enter into Business Associate Agreements (BAAs) with end-users or patients. All obligations for HIPAA compliance, patient consent, and message content rest with the healthcare provider. 5. Limitation of Liability To the maximum extent permitted by law, Scriptyx is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of or inability to use the text messaging service, including but not limited to errors in delivery, message content, or service interruptions. 6. Modification of Terms Scriptyx may revise these Terms at any time. Your continued use of the service after such changes constitutes acceptance of the updated Terms. 7. Governing Law These Terms are governed by the laws of the State of California, without regard to its conflict of laws provisions. 8. Arbitration Agreement Any dispute arising out of or relating to these Terms or your use of Scriptyx’s services shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall occur in San Mateo, CA.
